Member understands and agrees to:

The person submitting this form states and agrees that they have the legal authority to act on behalf of the company they are submitting.

ASC agrees to submit member to carriers for the purpose of obtaining discounts with one or more LTL and/or other freight carriers which ASC offers. While ASC would like to have all members attached to our pricing, the final approval lies with the carriers. Member agrees that this agreement is a "Letter of Authorization" to be given to the carriers and that this agreement gives ASC permission to fully act on member's behalf to activate and attach member to ASC's carrier contracts for the purpose of getting member freight discounts.

Because ASC is simply an association; it cannot be held liable for mistakes made by either the member or the carriers. ASC is not liable for errors resulting from incorrect Bill-of-Ladings, incorrect classing of shipments, inaccurate weight or dimensions, loss of discount incurred from shipments to non-direct destination points or other errors. ASC is not liable for changes or errors in carrier policy or pricing, any damage or loss to any shipment or quotes received from carrier, ASC or carrier software.
Note for LTL Shipments: New Merchandise item's must have a proper NMFC# on the bill-of-lading at time of pickup for proper carrier liability. Minimum carrier liability on used household items, personal effects, and shipments lacking NMFC# is 10 cents/lb.

Member understands that ASC receives a small commission from the carriers and only receives commission if member pays carrier invoices on time. Member agrees to make all shipments prepaid, not collect. Sometimes, ASC may need to allow Member to third party bill shipments to ASC. ASC shall be entitled to recover all costs of collection, including reasonable attorney's fees.

ASC reserves the right to terminate this agreement at any time for any reason. Member may terminate this agreement at any time for any reason by notifying ASC in writing, while realizing that each carrier must be notified and that 90 days or more may be needed to complete termination after all past invoices have been paid in full. Member shall indemnify and hold ASC harmless against all claims, costs, or damages, including, but not limited to, direct and incidental damages arising from such authority and agrees to pay and discharge all costs and expenses, including reasonable attorney and travel fees.

ASC may be required to file cargo claims for various carriers. The parties stipulate to jurisdiction and venue in the State and County where ASC's main office is located for any dispute or litigation. Member gives ASC permission to fax and email updates and other information to member. ASC does not sell or give out member information to others, except ASC may need to give information to carriers or member's bank or use a member's name for reference.

We may amend this Agreement at any time by posting a revised version on our website. The revised version will be effective at the time we post it. It is the memember's responsiblity to check this policy. If member strongy disapproves of this policy they can cancel their membership.
